HVAC contracts: the install contract and the scope it binds

The signed proposal is usually the contract in residential work, and that is fine as long as the proposal carries the clauses a contract needs. In commercial work the contract is a separate document and the scope of work is an attachment to it. Either way, the contract does three things: it defines the job through the scope, it fixes the money through price and payment terms, and it allocates risk through warranty, exclusions and change orders. The scope of work is the contract's subject

The HVAC scope of work template describes the job in verifiable terms: equipment by model, what is removed, what is installed, what is connected, what is tested, and what standard the work meets. Everything the contract says about price, schedule and warranty refers back to this scope, so an ambiguous scope makes the whole contract ambiguous. Write it as the punch list you would use to sign the job off.

Price, payment and what triggers each payment

State the price per the scope, the deposit, the progress payments if any and what event releases each, and the final payment due at completion or at a defined milestone such as inspection passed. Exclusions, discoveries and change orders

List what is excluded from the scope and set out the procedure when something excluded is discovered on site: work stops, a priced change order is issued, work resumes on signature. This clause is what turns a surprise behind the wall into a paid line rather than an argument. It belongs in every HVAC installation contract template regardless of the size of the job.

Warranty, split in two

The equipment warranty is the manufacturer's and depends on registration; the labor warranty is yours and should state its length, what it covers, and what voids it: modifications by others, lack of maintenance, misuse. Offer the maintenance agreement in the same paragraph, because the agreement is how the customer keeps the warranty's conditions.

Permits, schedule, access and the boring clauses

Who pulls the permit and who pays for it, the start window and what delays it, access and working hours, disposal of the old equipment and the refrigerant, insurance held, and the governing law for disputes. None of these are read until something goes wrong, which is exactly when they earn their place in HVAC contracts.

In most residential work, yes, if it carries the scope, price, payment terms, exclusions, warranty and signatures. Check your state's requirements for home improvement contracts, some of which specify clauses and a cancellation notice.

How detailed should the HVAC scope of work template be?

Detailed enough that a technician who never saw the sale could install the job from it and a customer could check it. That is usually a page for a residential replacement.

Do we need a lawyer for the HVAC installation contract template?
